Equality Now's comment on Docket No. ED-2018-OCR-0064, RIN 1870–AA14, Nondiscrimination on the Basis of Sex in Education Programs or Activities Receiving Federal Financial Assistance (United States)

Equality Now would like to take this opportunity to express our strong opposition to the Notice of Proposed Rulemaking (“NPRM”) on Title IX, issued by the Department of Education on November 29, 2018. We are very concerned with several sections of the proposed rules which would decrease protections for adolescent girls. The proposed changed would also violate the United States' obligations under international law, which prohibits discrimination on the basis of sex, and its commitments under the 2030 Agenda for Sustainable Development (the Sustainable Development Goals), which calls for inclusive, equitable and quality education as well as gender equality and the empowerment of women and girls. We therefore urge the Department of Education to reverse course and dedicate its efforts to advancing policies that ensure equal access to education for all students, including by preventing and addressing sexual harassment.
